Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Aethyl mobile application and website (the "Service") operated by Circit LLC ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

Use of Service

Aethyl provides a platform for analyzing social media videos and images to estimate whether they were generated or materially modified by AI. You are responsible for safeguarding your account and for all activities that occur under your account. You must be at least 13 years old to use the Service.

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You may not use the Service in any manner that could damage, disable, overburden, or impair the Service.

Community Standards and Content Moderation

We are committed to maintaining a respectful and constructive community. There is absolutely no tolerance for objectionable content or abusive users on our platform. By using our Service, you agree to adhere to the following standards:

• Do not submit content or post comments that are illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Do not submit sexually explicit content, content depicting minors in a sexual context, or content that infringes upon the rights of others, including intellectual property rights
• Do not use the Service to impersonate another person or entity, or to harass, defame, dox, or target any person or group
• Do not engage in any conduct that restricts or inhibits any other user from using or enjoying the Service
• Do not attempt to gain unauthorized access to the Service, other user accounts, or computer systems
• Do not attempt to scrape, reverse-engineer, or overload the Service
• Do not use the Service to generate misleading "proof" of authenticity or forgery regarding content you know to be fabricated or altered

We have implemented the following moderation tools:

• Reporting System. Users can report objectionable comments directly within the app.
• Blocking Feature. Users can block another user to hide that user's comments from their view within the app.
• Moderation Team. We review and respond to reports within 24 hours and take appropriate action, which may include content removal and account termination.

We reserve the right to remove any content that violates these Terms and to terminate or suspend accounts of users who repeatedly violate our policies. Appropriate action may include content removal and account termination.

Circit LLC reserves the absolute right, at our sole discretion, to remove, edit, or modify any content submitted to the platform that we deem inappropriate, harmful, or in violation of these Terms, without prior notice to the user. We also maintain the right to suspend or permanently terminate user accounts that violate our policies, without warning or explanation. By using our Service, you acknowledge and accept that all moderation decisions are final.

AI Detection Feature

The Service uses multiple AI providers to estimate whether a piece of media was generated or heavily modified by AI. By using this feature, you agree to the following:

• Functionality. Aethyl combines verdicts from Google Gemini, OpenAI, and xAI Grok to produce a Trust Score.
• Third-Party Processing. Media files and extracted frames are sent to these AI providers for analysis. By submitting a URL, you consent to this processing. See our Privacy Policy for details.
• No User-Identifying Context. We do not share your account email, handle, or other identifying information with AI providers.
• Accuracy Disclaimer. Detection results are probabilistic estimates, not proof. Results may be wrong in either direction. Do not rely on Aethyl as the sole basis for legal, journalistic, or safety-critical decisions without additional verification.
• Prohibited Activities. Attempts to manipulate, bypass, or exploit the detection system are prohibited.

Users should verify important conclusions independently. We reserve the right to modify or discontinue AI detection features at our sole discretion.

Device Security and Data Usage

It is your responsibility to maintain the security of your device and access to the Service. We strongly advise against jailbreaking or rooting your device, which may expose it to security risks and could impact the functionality of the Service.

Our Service requires an active internet connection to function properly. You are responsible for any data charges incurred while using the Service, including roaming data charges if you use the application outside your home territory without disabling data roaming.

Content

The Service allows you to submit URLs, post comments, and otherwise make available certain information, text, and media ("Content"). You are responsible for the Content that you submit, including its legality, reliability, and appropriateness.

By submitting Content on or through the Service, you represent and warrant that: (i) you have the right to submit the Content for analysis under applicable law, including the rights of fair use or public availability, and (ii) your submission of the Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

By posting comments, you grant Circit LLC a worldwide, non-exclusive, royalty-free license to host, display, and distribute those comments within the Service and on shareable scan pages. You retain ownership of the comments you post.

Quotas and Paid Features

Free accounts have daily scan limits. Paid tiers (where available) increase these quotas. Quotas may change as we balance cost and reliability.

Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Circit LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Circit LLC.

Media content accessed through the Service originates from third-party platforms (TikTok, Instagram, X, YouTube, Reddit, and others) and remains the property of the respective rights holders. Aethyl stores copies only for the purpose of analysis and to provide playback within the Service.

Third-Party Services

The Service utilizes third-party services that have their own Terms and Conditions. These third-party service providers include:

• Firebase
• Cloudflare
• Railway
• Resend
• Google Gemini
• OpenAI
• xAI Grok

By using our Service, you also agree to comply with the terms and conditions of these third-party services as applicable.

App Updates

We may update the application periodically to improve functionality, fix bugs, or comply with changing requirements. You agree to install updates when offered to ensure optimal performance and security of the Service. We do not guarantee that the application will always be compatible with all device operating systems or versions.

Account Management and Deletion

You have complete control over your account and can delete it at any time through the app's Settings. The account deletion process removes your profile and personal identifiers (email, push tokens, notification history) from our systems within 7 days and anonymizes your comments and submitted scans. See our Privacy Policy for the exact scope of what is removed, anonymized, or retained. Once you initiate account deletion, the process cannot be reversed.

We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms or engage in activities that violate our community standards.

Limitation of Liability

In no event shall Circit LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; (iv) any reliance placed on a detection verdict or Trust Score; and (v) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Governing Law

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the Service.
